Filipino Cockfighting Bust Nets 5,000 Chickens

SAN DIEGO (AP) — Authorities made what they called the largest cockfighting bust in U.S. history with the seizure of more than 5,000 roosters, hens and chicks from two training grounds, officials said.

Agents found 4,400 chickens Saturday at a 7-acre compound in the Otay Mesa industrial area of San Diego. More than 2,500 birds were seized at the same place six years ago in what was believed to be the nation’s largest bust.

Fifty people were issued misdemeanor citations, punishable by up to one year in jail and a $5,000 fine, and ordered to answer to cockfighting charges in early December, said Paul Levikow, a spokesman for the San Diego County District Attorney’s office. If the defendants have a history of animal cruelty, they may be charged with felonies.

The cockfighting operation was managed and patronized largely by Filipinos, and fights were staged in the San Diego area, Levikow said. Many birds were sent to the Philippines or Hawaii.

ROCKSPRINGS ? When he left home late last year for a jail cell, Gilmer Hernandez was a little known rural Texas deputy charged with shooting into a carload of undocumented immigrants during a late night stop.

By the time he returned Monday, after 10 months behind bars for violating the civil rights of a woman injured in the shooting, Hernandez had become a national poster boy for conservatives in the bitter ongoing national debate over immigration.

To many, it was proof that undocumented immigrants have more rights than U.S. lawmen.

Columnists such as Ann Coulter and Phyllis Schlafly cited his case, as did primetime television pontificators like Lou Dobbs and Sean Hannity.

Focusing on the U.S. attorney who sent Hernandez to jail, protest groups vilified Johnny Sutton as “Johnny Satan” and “public enemy No. 1.”

But Monday afternoon, all such raucous partisan discourse was very distant when Hernandez walked into his living room, his wife, Ashley, on his arm, for the first time in almost a year.

“I’m home,” he said, giving his father-in-law, Jose Arredondo, a long, muscular hug. He then gingerly held his year-old daughter, Alektra, who predictably squawked in protest.

“I’m still the same guy. I’m not going to let this bring me down,” he said. “I’d like to thank everybody who wrote me letters and supported my family. It meant a lot to me. It meant I wasn’t alone.”

A little bit later, downtown Rocksprings became a Gilmer Hernandez welcome home carnival as the entire student body at the school complex, plus dozens of local residents, turned out to greet him.

More than 350 people crowded around the front of the school, blocking traffic, waiting to pay their respects to a local guy who had once taught as a substitute teacher there.

“Like the signs say, Gilmer is free and a favorite son has come home,” said Tooter Smith, a photographer for the local Mohair Weekly.

One of the first to meet him outside the school was his old boss, Edwards County Sheriff Don Letsinger, who had suffered along with Hernandez during the federal investigation and trial.

“I told him I loved him and I’m proud of him,” the sheriff said. “He stood up for what he believed in.”

Hernandez, 26, who cannot serve in law enforcement again because of the conviction, said he had no second thoughts about how he reacted on April 14, 2005, in the incident that changed his life.

“It happened in a split second. I was in fear of my life. I did what I was trained to do,” he said.

City Drops Charges Against Man Who Burned Mexican Flag At The Alamo

A former peace officer burned a Mexican flag in protest of the U.S. policy toward undocumented immigrants, and his demonstration at the Alamo has garnered national attention.

David Bohmfalk was set to go to court on a case of constitutional law regarding his right to burn a flag ? any flag ? on the steps of the Alamo. Now it appears the city is unfurling the white flag of surrender.

Bohmfalk’s protest took two minutes, and the result was a $198 ticket for burning without a permit.

Free speech, Bohmfalk says, is worth fighting for. But now he won’t have his day in court. Hours after the story first aired on KENS 5, the charges were dismissed.

“I am out financially, and I’ve had a lot of emotional turmoil over this,” Bohmfalk said.

Bohmfalk has waited several months for a court date. Three court settings were rescheduled during that time.

The city attorney’s office says it wasn’t until a court date was set that prosecutors got their first look at the case. They admit it should have been thrown out, but that it was lost in the sheer volume of municipal cases.

“We’re talking a thousand people a day walking through that door, and no one’s happy,” Deputy City Attorney Joe Niño said.

Bohmfalk’s case has made the national news. Across the Web, it’s the talk of patriotic Web sites, and some blogs are critical of him.

His attorney, Jason Jakob, says officers detained the former peace officer that May Day trying to find something to charge Bohmfalk with. All the while, he says, his client took some heat of his own.

“They tried to call him a domestic terrorist. They tried to get him for arson. They detained him for an hour and a half worth of his time. They allowed him to be spit on,” Jakob said.

His brush with the law and his attorney’s fees now have Bohmfalk considering more legal action against the city.

Bond was denied for an illegal immigrant accused of shooting a police officer whose bulletproof vest saved his life.

Officer Bret Glidewell was shot Sunday after pulling over a 1998 Chevrolet S-10 pickup around 5 p.m. for running a stop sign near 32nd Street and Sweetwater Avenue.

Police said the driver stuck a .45-caliber semiautomatic pistol out the window and fired one shot at Glidewell as he was walking up to the truck, hitting him right above the heart. Glidewell’s vest stopped the bullet.

The 22-year-old officer, on the force seven months, returned fire but the driver sped off.

Glidewell was checked out at a hospital and released.

He identified 35-year-old Jose Abel Cabrera-Somosa as the shooter based on a photograph.

Police used a GPS tracker in Cabrera-Somosa’s cell phone to track him to a home near Seventh Avenue and Loop 101, where he had been living for the past three months with 10 other people.

Cabrera-Somosa was arrested at the home around 11:30 p.m. and booked for investigation of attempted first-degree murder of a law enforcement officer and misconduct involving weapons.

Police found an S-10 pickup backed into the driveway of the home with what appeared to be two bullet holes in the rear window. The license plate associated with the shooting was found inside the truck, according to police; a different plate was affixed to the vehicle……

Cop critical of department after shooting

Phoenix Officer Bret Glidewell is sending a powerful message after his shooting Sunday night. The rookie cop says: “If Phoenix Police had had more enforcement and deterrence I probably wouldn’t of been been shot.” Glidewell made the statement through the police union, the Phoenix Law Enforcement Association.

The union broke with police chiefs last week claiming they should be allowed to call on the feds whenever they encounter illegal immigrants during traffic stops. Police say Glidewell was shot by an illegal immigrant from El Salvador. 35-year-old Jose Carbrera was arrested accused of shooting Glidewell during a traffic stop. Carbrera ran but was caught later at his home in north Phoenix.

A representative for the police union says he had a meeting with Mayor Phil Gordon to address the policy concerning illegal immigrants on Friday and warned Gordon if they didn’t change policy, another officer would likely be shot by an illegal immigrant. It happened quicker than anyone expected.

ALBANY - Senate Republicans roasted the state’s motor-vehicles commissioner for nearly four hours yesterday during a hearing on Gov. Spitzer’s controversial proposal to allow illegal aliens to get driver’s licenses.

While DMV Commissioner David Swarts insisted the policy change does not need legislative approval, the Republicans warned they could block the move by withholding funding next year when the second phase is to be implemented.

“We will not be idle when we see our state’s security in jeopardy, nor will the citizens of New York,” said Sen. Vincent Leibell, who chairs his house’s Committee on Veterans, Homeland Security and Military Affairs.

Leibell and other Republicans called on Spitzer to “just chill” by halting implementation of the plan and listening to critics’ concerns.

Swarts wouldn’t say if he will recommend the program be delayed, but Spitzer made it clear he has no intention of backing down, saying he does not govern by polls.

“Republican Senate committee hearings make clear that the Senate would prefer I abdicate my foremost responsibility to protect the safety and security of New Yorkers rather than implement a smart DMV policy change that advances both,” Spitzer said.

Senate Majority Leader Joseph Bruno in a statement said the latest Siena College poll showing overwhelming public opposition to the plan “makes abundantly clear what we already knew: that Gov. Spitzer’s plan to give driver’s licenses to illegal aliens is a threat to public safety and security, and is another indication that he is increasingly seen as unfit to govern this state.”

During the all-day hearing yesterday, senators and others charged the plan could lead to more terrorist attacks in New York, threaten overall national security, and make it easier for illegal immigrants to vote and purchase guns.

A defiant and sometimes evasive Swarts spent the first hour of the hearing reading a statement he said was meant to “clarify the misinformation out there and counter the hysterical rhetoric that serves only to play on people’s fears.”

He said the program will lead to safer streets by cutting down on unlicensed drivers, who are more apt to be involved in accidents.

And he insisted that the plan, which no longer requires applicants prove they are in the country legally, would actually increase public safety by creating public records on illegal immigrants who currently are untracked.

Swarts told skeptical lawmakers that while no system is foolproof, anti-fraud technology and specially trained DMV employees will make it far easier to catch people with fake documents.

But he acknowledged his department would not release records to federal officials without a subpoena or court order.

“Do you really believe we should entrust our national security with the Department of Motor Vehicles?” asked Sen. Andrew Lanza (R-Staten Island).

At one point, when it was mentioned that Osama bin Laden could get a license under the governor’s plan, Swarts flippantly quoted a columnist by saying “at least we’d know where he was.”

During another question, he was asked if he agrees it’s not in the national interest for terrorist cell members to have driver’s licenses. “We would not want that to happen,” he said.

ALBANY - An overwhelming 72 percent of New Yorkers - including 59 percent of Democrats - oppose Gov. Spitzer’s plan to allow illegal aliens to obtain driver’s licenses, a new poll shows.

According to the Siena Research poll released yesterday, just 22 percent of those surveyed supported the controversial measure.

“The voters’ message to the governor is clear: ‘No, no, no,’ ” said Siena poll spokesman Steven Greenberg. “Opposition to the Spitzer proposal is intense, with 41 percent strongly opposing it and only 7 percent strongly supporting it.”

Despite Spitzer’s contention that the opposition is being fueled by the “rabid right,” the Siena poll showed that Democrats oppose the governor’s plan by a 59-34 percent margin.

In New York City, with its large immigrant population, and the surrounding suburbs, the poll found that 70 percent oppose the plan.

Nearly two-thirds of New Yorkers agree that the Spitzer plan could pose a national security risk, while just 32 percent disagreed with the notion.

Republican Presidential candidate and Congressman, Tom Tancredo, announced that he plans to introduce legislation that would overturn a recent federal court ruling preventing the Department of Homeland Security (DHS) from sending “no-match” letters to potential employers of illegal aliens.

The letters would be sent to employers that have employees that have submitted fake or incorrect social security numbers. The agency was prepared to send 8.7 million letters prior to the preliminary injunction.

“Congress must take out the legs from underneath the court’s misguided ruling with legislation,” said Tancredo. “By giving DHS direct authority from Congress to send out the no-match letters, the court would be hard pressed to find another excuse to prevent DHS from enforcing our immigration laws.”

The federal district court judge, Charles Breyer of San Francisco, ruled earlier this week that DHS had exceeded its authority in issuing new no-match letters to employers.

The new letters require employers to verify employee Social Security Numbers and submit new paperwork to DHS. If the employer still refuses to do anything about potentially illegal employees within 90 days, DHS’ new rule says that he may be held criminally liable.

Canadian activists are demanding Prime Minister Stephen Harper fulfill a promise and submit the Security and Prosperity Partnership of North America to a national referendum for an up or down vote.

“The Prime Minister of Canada and his cabinet in both Liberal and Conservative regimes support the unification of North America as witnessed by the fact of [former Prime Minister] Paul Martin and [current Prime Minister] Stephen Harper being signatories to the SPP process,” said Connie Fogal, leader of the Canadian Action Party.

Fogal rejects the idea that the vote on SPP should be taken solely in the Canadian Parliament.

“A decision about the restructuring of Canada into an integrated North America is not a decision for parliament, but for the citizens of Canada,” Fogal says. “What every Parliamentarian should do is call for a no confidence vote on this issue to cease unification of Canada, the USA and Mexico, and then run a campaign on the life of Canada not its death.”

Maude Barlow, the National Chairperson of the Council of Canadians, agrees.

“So far, only 30 CEOs from North America’s richest corporations, including Lockheed Martin, Bank of Nova Scotia, Chevron, Power Corporation and Merck, have had any meaningful input,” a news release on Barlow’s website proclaims. “Only they have been invited to annual closed-door meetings of SPP leaders and ministers, such as the one that took place in Montebello, Quebec, in August.”

ALBANY ? Since the terrorist attacks of Sept. 11, 2001, noncitizens who legally obtained New York State driver?s licenses have been given licenses stamped ?temporary visitor? along with the date their visa expired.

No longer.

The Spitzer administration three weeks ago quietly eliminated the state policy that required the special identification stamp on the driver?s licenses for noncitizens who are legally, though temporarily, residing in the United States.

The policy change also eliminated the accompanying expiration date that was intended to show when the person?s legal right to be in the United States ended ? raising the chance that a valuable form of identification could remain in the hands of people who want to remain in the country illegally.

This recent decision to stop labeling licenses of noncitizens comes as the governor is also pressing ahead with a companion policy in which the state would permit immigrants here illegally to obtain driver?s licenses.

Opponents of Gov. Eliot L. Spitzer?s latest move say it sends a signal that New York does not care whether individuals are within its borders illegally. They point out that three of the terrorist hijackers on 9/11 had expired visas and that driver?s licenses were among the forms of identification they possessed to carry out their plot.

SACRAMENTO — Assembly Speaker Fabian Nuñez offered some explanation Friday for a few campaign fund expenditures in Europe, but refused to elaborate on how tens of thousands of dollars of other purchases were related to governmental or political business.

“Every expenditure I made has been totally legitimate,” the Los Angeles Democrat said at a Capitol news conference.

he Times reported last week that since becoming Assembly leader in 2004, Nuñez has used campaign funds to travel extensively, visiting exclusive hotels and restaurants in Europe and South America.

He also has spent tens of thousands of dollars in campaign money on “meetings” and “office expenses” at businesses such as Louis Vuitton in Paris, a wine bar in Sacramento and clothier Robert Talbott in Carmel.

State law allows politicians to spend political donations on travel, meetings and gifts so long as the purchases are related to a political, governmental or legislative purpose.

“Maybe I put my foot in my mouth a little bit,” he said, by telling The Times last week: “There’s not too big a difference between how I live and how most middle-class people live.”

“Expenses that have been made are legal expenses, fully, to the letter of the law. I have nothing to hide from anybody, but I refuse to give you the fullest explanation on each and every item for the last . . . 3 1/2 years,” Nuñez said.

He said the “distraction” of questions about his campaign expenditures has made him hesitant to accept invitations to visit Mexico and Asia this year.

“I might just not do them at all,” Nuñez said huffily.

Opposition protesters have torn down a bronze statue of former Mexican President Vicente Fox, just hours after it was erected this morning.

Workers put up the commemorative 10-foot statue before dawn in the city of Boca del Rio, in Veracruz state.

But by midmorning a crowd of about 100 angry protesters began egging the statue, fastened a rope around its neck and pulled it to the ground.

Many were members of the centrist Revolutionary Institutional Party, which governed Mexico for much of the 20th century until Fox (of the conservative National Action Party) won a presidential election in 2000.

The statue’s inauguration ceremony, scheduled for tomorrow, has been canceled.

In recent days Fox has denied accusations of corruption during his government.

Last week Fox gave interviews to various U.S. networks and was questioned about how he got various cars and properties during his time in office.

The scene was reminiscent of the scene in Baghdad following the U.S. invasion of Iraq, where U.S. troops and members of the Iraqi National Congress pulled down a statue of Saddam Hussein opposite the Palestine Hotel.
