This was easily the most emailed story of the day. I must have had a dozen emails about this veteran tearing down this Mexican buzzard rag.

“I’m Jim Brossert and I took this flag down in honor of my country with a knife from the United States army. I’m a veteran, I am not going to see this done to my country. if they want to fight us, then they need to be men, and they need to come and fight us, but I want somebody to fight me for this flag. They’re not going to get it back.”


This afternoon we received a call from a viewer who said a business near downtown Reno was flying a Mexican flag above an American flag… which is in fact illegal.

This, after photos and comments about the flag were posted on Craigslist this morning. When we were able to have a photographer go and check everything out we found the story to be true.

It also didn’t take long before the situation provoked a strong reaction. We are now going to show you , unedited, what happened. to see what happened.

A Mexican bar owner in Reno Nevada flew the Mexican flag above that of the United States. Only problem is that this is specifically illegal under United States Code Section 7, Title Four, which states,

(c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.

The brazen effrontery of the bar prompted an American veteran to cut down both flags. But when CNN reported on the event, they managed to significantly skew the perception. The CNN report simply states that the veteran was angry that the Mexican flag was placed above that of the US- no mention was made that it was in fact illegal under US law. CNN compounded their offense by showing in their video clip, not the actual words of the relevant US code that outlaws this action, but instead ‘flag rules’ taken from, thus downplaying the actual offense, by suggesting that athe law is in fact merely recommended behavior. As in so much relating to the illegal alien lobby, apprently it is OK with CNN for immigrants to disrespect and/or disobey the laws of our country, but let one American try to react, and they scream bloody murder.     The man who tore down the flag is a disgrace to this country.

    How dare you people call him a hero. This type of pull-your-military-knife-out-and-challenge-obvious-pacifists-to-a-fight is the same attitude that has us in the terrible state of world affairs we are in.

    Would it have been too much trouble to talk to these Hispanic gentlemen before violently slashing the flag down and leaving the Mexican flag on the ground? All intimidation.

    I am a white American male and had no idea that it is illegal to fly a flag from another country above ours. I applaud the store owner for keeping his cool and not resorting to the same barbaric tactics. By supporting this veteran you are supporting an intolerant criminal.”

    This knuckle head would definitely have been a British sympathizer if he had been alive during our Revolutionary War. If everyone thought as he does then there would have never been a U.S.A.

    Just my opinion of modern cowards.

    That reminds me of the ledgend of the Mexican flag. It is something like this: The Mexican people were wandering aimlessly when their greedy and corrupt God of Invasion gave them a command. The command and the accompanying instruction booklet told them to wander in the desert until they came upon a vulture sitting in a rape tree sucking the life out of Uncle Sam, the entire tableau surrounded by fetid swamp and debris. When they came upon this sight they were to make camp and attempt to build a city.

    He will be in trouble with the local authorities if the bar owner files a complaint. He did willfully cause property damage and stole the guys flag. Do I smell a hate crime accusation? I’ll buy him a beer too Eddie B. Let’s keep our eyes and ears open to this one patriots.

    The bar owner was aware of what he was doing; i.e., antagonizing the citizens of this country. I’m not falling for this “I’m only showing support…” I’m sick of these people using our own laws against us. So the flag the vet took belonged to the bar owner. What about the mental cruelty that these people are inflicting upon the American public by doing things like this? If the bar owner had been out there beating people with a stick and the vet took the stick away, would he still be held accountable for stealing the bar owner’s property? It’s the same to me — and I dare say to most other veterans.

The shop owner looks stupid picking up the mexican flag, walking back inside the shop with his tail between his legs.     How come nobody was charged in that one? Clearly it is against that law to do that.

    Ignorance of the law is no excuse for breaking the law. “Gee I didn’t know it was illegal to run that red light officer” has been used as an excuse once or twice before and we can all guess how those cases ended. It is the responsibility of ALL Americans and for whom ever sets foot on U.S soil to know each and every law, ordinance, statute, vehicle code, penal code etc etc…

    These creep illegals prove themselves unworthy of citizenship of any capacity by the fact that they are responsible for some of the most outlandish, most absurd and ignorant excuses ever manufactured. I could care less if this bar owner just didn’t know about the flag thing. A fed up American simply taught him the law about the flag. Hey big Jim was just doing his civic duty.

    And by the way, Faye could be right about the emotional damage done to American citizens who witnessed the buzzard flag flying above the American flag. Anyone who in the commission of a crime and either physically or emotionally affects no matter how slight is also guilty of simple assault (penal code 242). I and seven of my neighbors successfully brought suit against a home owner for allowing illegal activity to occur on his property (renting to illegals) that resulted in emotional and mental anguish. This bar owner is no different. His illegal activity had obviously offended many many people in that area.

    Anyone want to contact a personal injury attorney from Reno and nail this invader to the wall? Faye, get ahold of one and lets see if we can make it fly.

    PS: There is also a federal law pertaining to the fact that if anyone is caught desecrating the American flag, well the individual whom assaults the a hole will only be fined one dollar. That’s it, no more punishment other than paying a one dollar fine for that type of assault. I will Google it and find the law and post later unless someone beats Me to it.

    Several states have passed legislation regarding the assaulter of a flag burner. The fine is $5.00, Burning or desecrating (like the mexican bar owner did) both fall under desecration.

    I believe it’s not a law, only a flag code. But my husband is adamant it’s law, he’s been taught since he was knee high that it’s a law… it’s always been a law… and it will remain a law, and he said **** the ACLU, pull that school’s funding. It is painful for veterans to watch this flag thing. We’ll have to check out the mental cruelty thing. Especially in light of this one:

    Peter Lynch is a veteran of 8 years and also a UNM freshman student. UNM has a new president and a new latino organization on campus flexing their muscles. It appears to me that this whole situation was a comedy of errors by the campus ROTC and the latino organizations neglecting responsibility for the foremost symbols of two countries and then a Dean?s office not taking appropriate action. Yet, Peter Lynch has been brought up on criminal charges for a $20 flag (at most) and they?re trying to get him prosecuted for a hate crime.

    I’ve been up all night e-mailing this story to VFW, media, individuals, organizations. Send these people a little joy note, please. Here’s what I sent:

    Is this how Albuqueque and the state of New Mexico treats our veterans? Arresting him for tearing up a $20, at the most, foreign flag flying over U.S. soil? I read all about UNM, their new president, their new diversity department. I read Lobo, the Reiman discussions, the myspace article. The whole thing looks like a comedy of errors and irresponsibility on the part of the ROTC and the latino organization in taking care of the foremost symbols of both our countries. Then you have university department heads twisting the myspace entry and wanting to prosecute for “hate crime.” Is this the kind of professional conduct you expect of your educators? And a new president of the university that accuses the vet of xenophobia? Well, I’m a vet. Daughter of a vet. Sister of a vet. Married to a disabled, retired vet. And I feel the same as Peter Lynch. And I would have done the same. So would my dad, my brother, and my husband. A foreign flag flying alone indicates sovereignty over that soil. That’s unacceptable. I can guarantee you that I will spend the rest of the night contacting every organization and individual I possibly can. Have ya’ll gone completely ding-a-ling or what?!!

    Thankfully there were only two garden variety Mexicans standing there. If he was surrounded by 10 vato loco cholos, I don’t think he would’ve done it. Cuz if he did, he probably would’ve gotten killed for it. Of course, when you’re that old, I don’t think you really care anymore what could happen, you just do what you feel is right.

    The Mexican was speechless? Maybe he just couldn’t speak English :)
    And they’ll twist this whole thing around to make Broussart the enemy, charge him with a hate crime, etc. But most Americans would stick up for this guy, I believe.

    I haven’t seen this story on any of the main pages of the MSM sites. Yeah, they don’t want people to see this, an American standing up for himself. They’d rather just brush it under the rug, cuz god forbid if other Americans might get the same idea.

    Guarddog, I realize that is their first amendment rights, but they are still breaking the law against Flag code 8a by displaying it upside down.
    Section 8a. “The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property.”

    My point is that the bar owner who displayed the our flag below mexico’s flag will most likely not face any charges, just as the creeps who displayed our flag upside down didn’t either.
