Unsatisfied with thwarting a Republican effort to authorize $3 billion for a border fence, congressional Democrats are trying to enhance the incentive for illegal aliens to enter the United States by removing the citizenship requirement from the popular State Children’s Health Insurance Program (SCHIP). The Republican Congress in 1996 passed legislation blocking people who are in the country illegally from claiming benefits from the federal government, and when SCHIP was created in 1997, states were required to verify citizenship. But Democrats want to take that sensible requirement for Medicaid and SCHIP and leave it to the discretion of each state.

This reflects the Democrats’ eagerness to offer free services to illegals at taxpayer expense, undermining the principles of both immigration law and good governance. And it is also a step Democrats want to take toward expanding SCHIP, like their plan to expand its coverage to include children from middle-income families that make up to $83,000 per year â?? a plan encompassing more than 70 percent of American children. (When SCHIP first came into being it was only for families with incomes up to double the poverty level, or $40,000 for a family of four.) Expanding the program will cost $50 billion over five years; expanding it by giving states the option to not enforce the citizenship requirement pushes the price tag up even higher â?? although just how much would depend on how many states decide to include illegals in the program.

Bruno Kirchenwitz


Authorities in Colorado say they have issued an arrest warrant for a man suspected of shooting at a 7-Eleven store because the clerk had worn a cap â?? while off-duty â?? supporting the U.S. Border Patrol.

The clerk, Bruno Kirchenwitz, who alleges he then was fired over the incident related to his opposition to illegal aliens, already had left the building and was unhurt in the shooting. Another cashier who was on duty and several customers were unhurt.

But authorities in Basalt, where an estimated 75 percent of the convenience store’s customers are Hispanic, have named Ricardo Ramirez, 22, as a suspect on counts of first-degree assault and felony menacing for the June 26 attack.

Basalt police chief Keith Ikeda confirmed the name of the suspect, and police said they are working on the assumption the gunfire was in retaliation for the Border Patrol cap the clerk wore to protest illegal immigration.

Basalt police said Ramirez made a purchase at the store with his credit card, then allegedly returned with another man after a few minutes to pump five shots at the store.

Kirchenwitz, 54, an immigrant from Germany, said he wore his cap while off-duty, and often has complained that illegal aliens undercut wages for other workers.

Corporate officials said they dismissed him shortly after the shooting when an internal review raised their concerns about his conduct. However, officials declined to elaborate, saying their corporate policy bars disclosure of personnel matters.

The announcement came shortly after the two store customers confronted Kirchenwitz over his hat, and then a series of rifle shots blasted through the store’s window in front of the cashier’s station.

Kirchenwitz has continued to insist he was dismissed for exercising his free-speech rights. He recently passed a lie detector test, paid for by Denver’s KHOW radio, that indicated he didn’t instigate the clash with the two men.

Ikeda also reported a car, 1996 tan Honda sedan with Colorado license plates, was reported leaving the area, and three shell casings for .30-caliber bullets, used for an M-1 carbine rifle, were found near the store.

Authorities said Ramirez’ name arose during interviews with witnesses.

Kirchenwitz said the two men who confronted him came into the store and asked if he was the man who wears a U.S. Border Patrol baseball cap.

Kirchenwitz acknowledged he wears the cap to and from work but never on the job.

The men, he said, threatened him with something like, “We’re going to show you what we think of that hat when we catch you alone.”

Kirchenwitz told the Aspen Times he “smiled and laughed and made jokes, then shooed them out the door.”

The men said they would wait outside while he finished his shift, but they left a short time later, at about 9:30 p.m., said Kirchenwitz, who got off duty at 10 p.m. then caught a bus. The shots were fired a short time later.

When I read this story, I was filled with more a sense of sadness and loss then of anger. Sadness that comes with a sense of loss or death. California Dreamin? That is what The Golden State Is becoming, A dream of it’s former self. The whole ideal of what California is or more to the point, what it was, is disappearing before our eyes. A culture so unique, so unmistakably American, it was envied around not just around the country but also around the world.

All that is changing now. A death is coming. Massive illegal immigration, liberal legal immigration, ands their multiple descendants are warping California into something so foreign, so different that the metamorphosis will result in a California that will be unrecognizable from it’s glorious all American past.

The anger comes in when you stop and think that much of this change is due to illegal and unlawful immigration. Something that wasn’t supposed to happen. This massive demographic change of historic proportion, from people of a non-assimilating different culture, will change many things that we know and love about California.

But much of this could have been stopped or at the least curtailed if our lame pandering elected officials did their job as they were sworn to do. To think in terms of the good of society as a whole, not just pieces of it. To have some forethought into what these demographic changes will do. But instead, they pander to certain groups. Whoring themselves for precious votes to better the odds of keeping their jobs through the next election cycle. Bucket please.

There is still hope to slow down or at least this cultural killing machine, but time is running out. I’m angry but right now, on this occasion, more sad and melancholy. A death or the possibility of a death can do that to a person. GuardDog

“Which one do you want?” Porras says to 2 1/2-year-old Alicia Molina Correa, holding up a game and a puzzle with children on it. “Cuál quieres, el juego o los niños?”

State demographers predict Latinos will be a majority of Californians by mid-century, but in preschool classrooms like Porras’, the future is now.

For the first time in modern history, most of the babies being born in California are Latino, according to an analysis of state birth records through 2005 by the Mercury News. Population estimates from the U.S. Census Bureau also show that for the first time in 2004 more than half of the children under age 5 in California are Latino.

2004 was the first full year when the number of babies born to Latina mothers nudged past 50 percent of the children born in California; it reached 51.5 percent in 2005. These newest Californians are the leading edge of a Latino demographic surge that will remake the state in unknown ways during the coming decades. But those changes, say demographers, will be driven primarily by the birth of native-born children - not by immigration.

Every toddler in Porras’ San Jose classroom one recent afternoon was Latino, and demographers and educators say the state’s future quality of life will be determined - starting now - by the quality of education produced inside thousands of similar classrooms. While more Latino babies are being born, state birth records show the transition to a Latino majority among California’s youngest children is also caused by a 40 percent drop in the number of children born to white and African-American mothers since 1990.

“The implications for the future are: We aren’t talking about an ethnic immigrant community, but an ethnic citizen community,” said Harry Pachon, president of the Tomas Rivera Policy Institute in Los Angeles, a think tank that studies issues relating to Latinos.

But with more than 40 percent of Latinos marrying into other ethnic groups, Pachon thinks the emerging majority will remake racial and ethnic identity in California. “It might be that the white category might get a little bit darker in California in the next 20 years,” he said. “It’s going to be harder to talk about `them,’ when it’s really `us.’ That’s what the figures seem to indicate.”

Judy Bugarin, a 40-year veteran of early childhood education and director of the Parkway Child Development Programs for Santa Clara County, feels responsible for better serving a student population that is now about 80 percent Latino.

“Our goal is that they become fluent in English by the time they’re ready for kindergarten,” Bugarin said as she watched Porras introduce children to English by saying each phrase in correct English before repeating it in Spanish. “That’s where we’re trying to close the achievement gap, by supporting English so they can do well in school.”……

Ethnic Cleansing of Americans in America’s Cities

Visited Los Angeles lately? How about Miami? What about New York City? How Houston, Texas? Notice anything? Millions upon millions of people from foreign lands reside illegally in our communities.

A Chicago reader echoed a growing crisis in America where Americans by the millions must step aside for people who broke into our country.

â??As a native of the Chicago area I have been aware of immigration my entire life–as a youngster in the 60s we had many Central and Eastern Europeans in our community and they and their children learned English as soon as possible– and how the “melting pot” worked so well until 1965,â? Terry said. â??Although aware, I was not overly concerned until May 1, 2006. I was stunned to see all the Mexican flags, pictures of Che Guevara, and nasty slogans in Spanish by the hundreds of thousands of marchers in Chicago.â?

Terry continued, â??Much more disturbing is all the disinformation coming out of the Chicago Tribune, Sun-Times and the various Suburban daily newspapers. The editorial pages have been fair, giving both sides space in the letters to the editor section, but the reporting and the columnists have been very one-sided in their support of illegal immigrants. Almost every story is pro-immigration, feel good immigration stories or stories about how deportation will “break-up” families. Stories about the Latin Kings or illegal alien drunk driving accidents would make Geraldo Rivera proud. Those are only gang banger or drunk driving “incidents” not illegal immigration issues.

â??To make a long story short and to keep these comments from becoming a rant, I contacted both and to air their videos and PSA’s on my cable-TV channel ( I really believe people need to see the other side of the story, especially the population statistics put forth by NumbersUSA. The sprawl in the Chicago area has become overwhelming as Native Americans are pushed further and further out, the result of cultural and ethnic cleansing of neighborhoods. Today there are four Spanish Language TV Stations, 17 Spanish language Radio stations and numerous Spanish language publications, church services, street signs, box store signage, as well as government documents in Spanish. My son’s former grade school has hired three teachers to educate children in SPANISH! Even though Chicago is over one-thousand miles from the Mexican border, the Hispanic population in the area is now approaching two million! In 1965 it was less than 100,000 and they were mostly citizens (Puerto Ricans).â?

There you have it! A snap shot of â??ethnic cleansingâ?? in our American cities by a Chicago native. While illegal alien migrants chant â??racismâ??, they methodically take over American neighborhoods and create their own enclaves filled with more of their own.

Take one look at Miami for â??ethnic cleansingâ?? of Americans by Cubans. Travel to Houston to see Mexicans â??ethnically cleansingâ?? Americans out of neighborhood after neighborhood. The same holds true in Atlanta, New York City, Dallas, Raleigh, North Carolina and any American city with major illegal alien overload.

If Black America thinks â??racismâ?? overpowered it for most of the last two centuries, â??ethnic cleansingâ?? of Black housing areas accelerates as Mexicans overwhelm neighborhoods in city after city. In Denver, where I live, Mexicans chase American Blacks out as fast as more relatives move in from Mexico.

Whether Senators Hillary Clinton, Kennedy, Specter, McCain, Reid, Hagel, Martinez, malcontent Cheney and others think â??multiculturalismâ?? warms Americaâ??s heartâ??they stand dead wrong. Multiculturalism rips at Americaâ??s core. It destroys our cohesive society. It destroys our single language. It wreaks havoc in our schools. It shreds the American Dream. It forces Americans into a showdown with 20 million people illegally living in and â??ethnically cleansingâ?? us out of our own country.

As it worsens from Bush not enforcing our immigration laws and Congress twiddling its thumbs, â??ethnic cleansingâ?? of we Americans out of our communities creates tension, anger, failing schools and frustration that boils into violence.

At some point, Americans will stand their ground. When they do, look for heated violence on small and large scales in communities across America. If they donâ??tâ??look for major ghettoes forming by million of illiterate, foreign language speaking, non-citizens creating their own version of the Third World right here in America.

Bud Hamilton, Sugarland, Texas, wrote, â??This situation already exists in my home town of Houston. We havenâ??t stood our ground in years. We have experienced violence on a small scale so far…..we already have ghettos teaming with illiterate Spanish speaking, non-citizens, and they already have created their own versions of the third world right here in Houston. There are parts of Houston where if you didnâ??t know better, youâ??d really think you are in Mexico.

â??Some of my neighbors have asked me, â??Arenâ??t you afraid youâ??ll get robbed walking down there at the park?â? And â??you shouldnâ??t walk at the park alone, itâ??s not safe.â? Sugar Land is an affluent suburb of Houston and even here theyâ??re taking over all public service areas while we native born Americans are staying away and letting them have them. Meanwhile Sugar Land is mentioned as one of the top 10 most desirable cities to live in due to our multicultural diversity of our schools and neighborhoods. Our homeownerâ??s taxes are through the roofâ?¦ our schools are rife with ESL classes. My grandchildren are in the minority in their â??wonderful diverse student bodies.â?

â??Muslim students are given special accommodations at our public schools while Christmas can no longer be celebrated and we have huge Mosques nearby our neighborhoods. I think itâ??s already too late. Bush has revealed his true intentions during his second term and like it or not heâ??s implemented them through the federal courts while ignoring our Constitution. Johnny Sutton targets our border guards and sends them to prison for trying to defend us from illegal drug runners while our schools, hospitals and police officers are overwhelmed servicing all the Illegals and their kids whom they are forbidden from asking if they are here legally.

John Hamilton said, â??I left Long Island, NY in 1981. I arrived in Silicon Valley and had a job as an electronics tech within two weeks. I earned a degree as I worked.

â??I first experienced racial discrimination while there. This was socially as well in the work place. The most vehement spewers were US born Mexicans. They actually attached themselves to and interferred in my life for years until they drove me away. I was told to go back to Europe. My family has been in the New World since 1600â??s or before.

â??In Florida, Tampa/St Petersburg I had the UN interfering on behalf of Bosnian Muslim relocaters. They sabotaged each Americanâ??s cars systematically until I was the last remaining American still standing. My supervisors were UN employees bragging how they had more rights than I! One an Italian and the other an African! We were replaced with more Muslims.â?…..

Virginia’s bid for help with illegals nixed

Federal immigration officials say they lack the resources to fulfill a proposed mandate by Virginia lawmakers to train staff at every state jail to start deportation procedures for illegal aliens.

“I cannot make that commitment to Virginia,” said William F. Reid, special agent in charge of U.S. Immigration and Customs Enforcement’s Washington field office.

Mr. Reid told members of the State Crime Commission’s illegal-immigration task force at a meeting Tuesday in Richmond that the state’s request would be evaluated against nationwide requests.

Twenty-two law-enforcement agencies nationwide have entered formal agreements with ICE to complete the training, authorized under Section 287(g) of the Immigration and Nationality Act, agency spokesman Richard Rocha said.

More than 65 other agencies have requested 287(g) training, he said.

ICE requested $26.4 million for 287(g) training from Congress for its fiscal 2008 budget, which would fund the training of 250 state and local law-enforcement officers, 350 jail beds and enforcement-related technology.

On Thursday, the Senate passed its version of the homeland security spending bill for 2008, which includes an additional $5.4 million for the 287(g) program. The bill also allows money left over from $3 billion in emergency border- and interior-enforcement funding to go to the training program.

The bill now must be squared with the House version Virginia Sen. Kenneth W. Stolle, co-chairman of the task force, proposed the mandate to create a uniform, statewide policy on illegal aliens â?? starting with Virginia’s 73 local and regional jails……

This has nothing to do with immigration but it is very important.


The Internal Revenue Service has lost a lawyer’s challenge in front of a jury to prove a constitutional foundation for the nation’s income tax, and the victorious attorney now is setting his sights higher.

“I think now people are beginning to realize that this has got to be the largest fraud, backed up by intimidation and extortion and by the sheer force of taking peoples property and hard-earned money without any lawful authorization whatsoever,” lawyer Tom Cryer told WND just days after a jury in Louisiana acquitted him of two criminal tax counts.

And before you consign him to the legions of “tin foil hat brigades” who argue against paying taxes, and then want payment to explain how to do that, he addresses the issue up front.

“These snake oil peddlers have conned millions of dollars out of many well-intended patriots and left a trail of broken lives in their wake. â?¦ These charlatans should be avoided, not only because they will lead you to bankruptcy and prison, but because by association they discredit those who are telling the truth,” he said.

The truth, he said, is where he comes in, with the launch of a new Truth Attack website that is intended to build on his victory, and create a coalition of resources to defeat â?? ultimately â?? the income tax in the United States.

Although the legal citations in the case tend to run the length of paragraphs, Cryer told WND the underlying issue is not that complicated. Essentially, he argued that income is not necessarily any money that comes to a person, but rather categories such as profit and interest.

He said the free exchange of labor for compensation has been upheld as a right by the Supreme Court, but that doesn’t necessarily make the compensation income.

If ever such an argument were to be presented widely, Cryer said, the income to the federal government would plummet. But not to worry, he said, the expenses could be reduced equally by eliminating programs, departments and agencies that also have no foundation in the Constitution.

“The Founding Fathers intentionally restricted the taxing powers of the new federal government as a measure of restraint on its size. By exceeding that limited taxing authority the federal government has been able to obtain resources beyond its intended reach, and that money has enabled the federal government to exceed its authority,” he said.

For example, he said, the Constitution does not empower the federal government to regulate education, or employment, and agriculture, yet it does so.

The jury in U.S. District Court in Louisiana voted 12-0 to find Cryer, of Shreveport, not guilty of failure to file income taxes for two years. He had been indicted in 2006 on charges of failing to pay $73,000 to the IRS in 2000 and 2001. The next step in his personal case will be up to the IRS and prosecutors, if they choose to continue the issue, he said.

But for the rest of the nation, he’s working with Save-a-Patriot, the Free Enterprise Society, Live Free Now and his own Lie Free Zone to spread the message of the truth.

“There are three points that are important,” he told WND. “There’s no law making the average working man liable [for income taxes], there’s no law or regulation that allows the IRS to contend that earnings are 100 percent profit received in exchange for nothing, and the right to earn a living through any lawful occupation is a constitutionally protected fundamental right, and it is exempt from taxation.”

Spokesman Robert Marvin in Washington’s IRS office told WND the Internal Revenue Code provides for taxation on salaries or wages, but when pressed for a specific citation, or constitutional provision, he said, “I can’t comment.”

NEW YORK (AP) _ A 23-year-old man was arrested Friday on hate-crime charges after he threw a Quran in a toilet at Pace University on two separate occasions, police said.

Stanislav Shmulevich of Brooklyn was arrested on charges of criminal mischief and aggravated harassment, both hate crimes, police said. It was unclear if he was a student at the school. A message left at the Shmulevich home was not immediately returned.

The Islamic holy book was found in a toilet at Pace’s lower Manhattan campus by a teacher on Oct. 13. A student discovered another book in a toilet on Nov. 21, police said.

Muslim activists had called on Pace University to crack down on hate crimes after the incidents. As a result, the university said it would offer sensitivity training to its students.

The school was accused by Muslim students of not taking the incident seriously enough at first. Pace classified the first desecration of the holy book as an act of vandalism, but university officials later reversed themselves and referred the incident to the New York Police Department’s hate crimes unit.

The incidents came amid a spate of vandalism cases with religious or racial overtones at the school. In an earlier incident on Sept. 21, the school reported another copy of the Quran was found in a library toilet, and in October someone scrawled racial slurs on a student’s car at the Westchester County satellite campus and on a bathroom wall at the campus in lower Manhattan. Police did not connect Shmulevich to those incidents.

Treatment of the Quran is a sensitive issue for Muslims, who view the book as a sacred object and mistreating it as an offense against God. The religion teaches that the Quran is the direct word of God.

Each is offensive and tasteless in its own way. But only one is a hate crime in the eyes of the law â?? C) â?? and 23-year-old Stanislav Shmulevich of Brooklyn faces jail time for it. Heâ??s a Pace University student arrested on Friday on hate-crime charges after he threw a Koran in a toilet at Pace University on two separate occasions, according to police.

Mark Steyn muses about the flushed Koran: â??Obviously Mr Shmulevich should have submerged it in his own urine, applied for an NEA grant and offered it to the Whitney Biennial.â?

Actually, no. The NEA would have turned Shmulevich in to the police, too. Now, if he had submerged a Bible in urine or coated a Torah in cow dung and submitted it for a federal grant, heâ??d be sitting prettyâ??and facing rave New York Times editorials instead of time behind bars.

Director Liam Clifford says: “Since January 2007, we have recorded an 80% rise in British nationals applying to move overseas. As this rise continues, so does the number of enquiries we receive from people asking for help in migrating to a new country. In recent months, we have received as many as 4,000 requests in a single week from people who have had enough of Britain and want to get out.”

He adds: “Ironically, the main reason for these people leaving the UK is the over-stretching of services caused by inbound immigration to the UK. We are aware of the issue of so-called â??white flightâ?? from certain inner city areas to the suburbs but now people are increasingly seeking a better standard of living offered by other countries.

“This phenomenon adds to the existing shortage of skilled workers already faced by the UK as they leave only to be replaced by low skilled EU A8 workers or low skilled refugees.”

An article in the July 26 edition of the Washington Times reports on the new strategy of force-feeding immigration rewards for illegal aliens in a piecemeal fashion rather than in a one-shot “comprehensive” bill that includes them all. This piecemeal approach to an immigration giveaway program reminds me of a car thief who realizes that he cannot simply break into a homeowner’s garage and steal his vintage sports car outright, so he resorts to stripping the car and over time makes off with most, if not all, of the prized vehicle. All he has to do after the piecemeal theft is to reassemble it in his own garage!

The level of chutzpah being demonstrated by those members of Congress who favor the strip-the-car approach to auto theft must really think that the citizens of our nation are brain dead! Polls indicate that the Congress has an even lower approval rating than the President, who is in a headlong dash to the basement where opinion polls are concerned. I recently read that Congress has a collective approval rating of 14%! That was not a typo; the approval rating for Congress stands at an unfathomable fourteen percent, yet many of these “Fools on the Hill” blithely continue along, refusing to do the work that the American people want them to do! The vast majority of Americans want our borders secured, and they want an immigration system with real integrity.

When the Senate stood poised to pass the utterly insane “Comprehensive Immigration Reform” bill I had dubbed the “Terrorist Assistance and Facilitation Act of 2007,” a significant amount of attention was paid to the largely meaningless question as to whether the bill constituted an amnesty for millions of illegal aliens. This debate was largely meaningless because although I certainly believed that the bill did constitute amnesty, the question I ask is, “So what?” It was obvious that aliens who had violated our laws would have been not only rewarded for their legal transgressions, but they would have been allowed to remain in the United States, work and send money back to their respective home countries, too. This was the reason that the majority of these illegal aliens violated our borders and immigration laws in the first place!

Some time ago, while explaining illegal immigration and the strategy needed to combat this crisis, I said, “No one would break into an amusement park if they could not go on the rides.” And requiring illegal aliens to pay a fine for being here illegally does not work. If you go back to my amusement park analogy, consider the fact that when you go to various amusement parks, whether Disney World, Sea World, Great Adventures or any other, you will find patrons waiting in long, long lines paying significant sums of money to go on the rides!…..

LONG BEACH - Tensions over the immigration debate ran high in the summer heat on Saturday, as activists on both sides of the issue squared off at a protest in front of St. Luke’s Episcopal Church.

“It’s always been a quiet, community church,” said Sgt. Ernie Kohagura, who was one of a dozen Long Beach Police officers there to keep the peace. “But today it’s like ground zero.”

Members of Save Our State, an anti-illegal immigration group, and members of the Minuteman Project gathered outside St. Luke’s Saturday morning to protest the church’s decision to provide sanctuary for Liliana, a 29-year-old illegal immigrant, and her U.S.-born infant son.

Several groups, such as Clergy and Laity United for Economic Justice, came to support Liliana and the New Sanctuary Movement, which works to provide illegal immigrants with safe havens.

Day workers plagued by wage theft
Local advocates hope to recoup pay in problem plaguing nation

Francisco Ramos worked a 40-hour week in June, framing houses in south Houston for promised wages of $320. But on payday, the 26-year-old carpenter got nothing.

His contractor dropped him off later that evening empty-handed.

A month later, he’s still waiting for his wages â?? as are thousands of other immigrants across the U.S. and Houston.

Wage theft is widespread among mostly illegal immigrant workers, especially those who are recruited on street corners and work in the shadows of the American labor force. And that work-related exploitation appears to be growing along with the country’s immigrant population.

In the nation’s first comprehensive study of day laborers, called ”On the Corner,” UCLA researchers interviewed 2,660 workers at 264 hiring sites in 20 states, including Texas and the District of Columbia. The 2006 study concluded that almost half of all day laborers experienced at least one instance of wage theft in the two months prior to being surveyed.

In Houston, a national worker’s advocacy group opened an office near downtown in April to recover wages lost by mostly immigrant workers. The Houston Interfaith Worker Justice Center is handling cases of wage loss mostly among immigrants hired by small businesses, contractors and individuals.

But if an immigrant â?? undocumented or not â?? is working for an employer with revenues exceeding $500,000 annually, a complaint can be referred to the U.S. Department of Labor’s wage and hour division.

In the department’s Houston district, the number of immigrants bringing wage complaints has risen dramatically, with 842 seeking back pay in fiscal 2006. That is up from the 371 in 2005 and 172 the year before, according to the Labor Department.

In the Houston district, the department identified $2.9 million in back wages owed to immigrants in fiscal 2006, up from $607,000 the year before. For 2006, the department collected backwages of $475,000 owed to 453 immigrant workers.

The labor department cases involve workers who were not paid, or paid less than minimum wage, or not paid for overtime hours……

Mr. Hernandez has been in city jail 12 times since June 2005 and was transferred to the Denton County Jail seven times. ICE records show that Mr. Hernandez was “voluntarily returned” to Mexico on March 31, June 7 and Nov. 29 of last year. The manpower cost of the operation was estimated at $6,260, according to city officials.

DENTON â?? Pablo Martinez Hernandez had a lot of experience at evading the law before hiding in a drainpipe under Locust Street for nine hours, leaving police and firefighters above wondering if they were dealing with a criminal or a corpse.

Mr. Hernandez, who is thought to be 24, though he’s given several birth dates, has been charged by Denton police with evading arrest or lying about his name or age six times in the past two years.

After city workers dug up the street to get him out of the pipe July 17, the 5-foot-4, 115-pound man said he wasn’t stuck but was just waiting for everyone to leave so he could continue his escape.

Still behind bars in the Denton County Jail and facing a charge of evading arrest, Mr. Hernandez declined to comment for this story.

Mr. Hernandez has been in city jail 12 times since June 2005 and was transferred to the Denton County Jail seven times.

He’s been turned over to Immigration and Customs Enforcement three times. He’s shown no proof that he is a legal U.S. resident, and Denton County law enforcement officials think he’s an illegal immigrant.

Yet each time he was detained, he was soon returned to Denton streets.

ICE records show that Mr. Hernandez was “voluntarily returned” to Mexico on March 31, June 7 and Nov. 29 of last year, spokesman Carl Rusnok said.

The agency has no record of a request for a detainer on May 29, he said.


That’s when Mr. Hernandez was released from the county jail after pleading no contest to possession of marijuana and being sentenced to 22 days. He had already served the time.

ICE last placed a detainer on him after his arrest July 17, Mr. Rusnok said.

“Note that voluntary returns are reserved for aliens from Mexico who have no serious criminal convictions,” he said in an e-mailed response to questions.

“A VR does not have the same legal consequences as a formal deportation. An alien who re-enters the U.S. after being formally deported commits a felony punishable by up to 20 years in prison.”

On July 17, a man found an intruder in a vacant house he owns and called police about 9:25 a.m.

When an officer approached the house, the intruder jumped out a back window and ran.

The officer pursued him for several blocks, across yards, up and down streets and over fences, until he ran down a drainage channel and crawled into a drainpipe 24 inches in diameter under South Locust Street.

The pipe opened onto nearby Eagle Drive. Officers quickly converged on both ends of the pipe, but Mr. Hernandez, whose identity the officers didn’t know at that point, didn’t come out. Officers yelled into the pipe in English and Spanish, telling him it was dangerous to stay in the pipe and asking him to come out.

Assistant Fire Chief Mark Klingele said the smallest firefighter on duty got stuck trying to crawl into the pipe and had to back out.

He carried an air tester that showed a dangerous lack of oxygen in the pipe, Chief Klingele said. Rescuers began pumping in oxygen……

La Voz de Aztlan has produced a video in honor of the millions of babies that have been born as US citizens to Mexican undocumented parents. These babies are destined to transform America. The nativist CNN reporter Lou Dobbs estimates that there are over 200,000 “Anchor Babies” born every year whereas George Putnam, a radio reporter, says the figure is closer to 300,000. La Voz de Aztlan believes that the number is approximately 500,000 “Anchor Babies” born every year.

The video below depicts the many faces of the “Anchor Baby Generation”. The video includes a fascinating segment showing a group of elementary school children in Santa Ana, California confronting the Minutemen vigilantes.
