BISBEE, Arizona (Reuters) - A U.S. Border Patrol agent must stand trial for murder in the shooting of a Mexican man trying to enter the United States, an Arizona judge ruled Monday in a case that drew criticism from Mexico.

Agent Nicholas Corbett was charged in April with four counts of homicide in the January 12 shooting of Francisco Dominguez Rivera shortly after he crossed the border illegally on a stretch of desert between Douglas and Naco.

Cochise County Justice of the Peace David Morales ruled the evidence supported lesser charges of second-degree murder, but threw out charges of first-degree murder, which supposes premeditation.

The ruling followed a preliminary hearing that heard evidence from three illegal immigrants present at the shooting, a pathologist, county sheriff’s detectives and two Border Patrol supervisors.

No date was set for Corbett’s arraignment.

Following the killing, Mexico’s Foreign Ministry complained of “disproportionate violence” and instructed the Mexican Embassy in Washington to investigate the circumstances.

Last year, border police captured 1.1 million undocumented immigrants crossing over the border from Mexico and recorded a soaring number of attacks on agents.

Lawyers for Corbett argue he shot Dominguez Rivera in self-defense after he was threatened with a rock.

An agent representing the local chapter of the Border Patrol’s union said he believed the charges against Corbett would not hold up at trial.

“I don’t think the prosecution has a good case, and the defense will absolutely beat it,” Brandon Judd said after the hearing.

    If Ramos and Campeon are any indication… watch out! Who knows what evidence the prosecutors will invent… err create… uh hum! I mean, have gathered.

    You’ve got that right SkyPainter! This is just more evidence that the Congress and White House are kissing the ass of the Mexican government every time it squawks about something. If it were me, I’d tell Mexico to shut up and keep it’s people home if it doesn’t like it. We owe that parasite country NOTHING!

    To listen to the Head Traitor (Bush) say that he can’t pardon Ramos and Compean because they were convicted by a jury of their peers and the evidence, is nothing but a bunch of b.s. The evidence proves that they did nothing wrong! They were doing their job!
    And now this scumbag drug dealer is suing because his civil rights were violated. I’m sorry—I didn’t know it was a civil right to attempt to smuggle drugs into the country and then run from authorities! I guess every drug dealer sitting in jail should file a class action lawsuit against the government for wrongful imprisionment and violation of civil rights.
    There are so many things wrong with the Ramos and Compean case, a village idiot could see that they shouldn’t be in prison! And the arrogance of our Fearless Leader, to simply dismiss it and say it can’t be done is a bunch of b.s. If he can pardon drug dealers and cronies, he can pardon these men! But he won’t because Mexico would complain, and we can’t upset the precious Mexican government.

    I thought only LEGAL American citizens had civil rights in our country! How do we know that lying drug dealer didn’t shoot himself in the a$$ - did they recover a bullet from him and do a ballistics test? Did Sutton have a conclusive report? I doubt it! I hope we can get Ramos & Compean a Congressional pardon because as usual worthless, TREASONOUS Bush isn’t going to do it!

    With all the billions of dollars we’ve wasted on these ungrateful ILLEGAL foreigners in our country we could’ve built the Great Wall of China on both of our Borders!

    When you click on “remember this video”, the name of the victim is Ramiro Gamez Acosta. The article above names the victim as, Francisco Dominguez Rivera.
    Maybe I need more coffee, but I’m confused.

    Maybe they have the victims name incorrect in that original story. It was Agent Corbett in the video.
