AUSTIN (Map, News) - A conservative Christian group has filed an ethics complaint against a federal prosecutor, arguing that he mishandled the case of two Border Patrol agents convicted of shooting a fleeing drug suspect and hiding evidence.

In the complaint, Kentucky-based Christians Reviving America’s Values asked the Texas Bar Association to investigate U.S. Attorney Johnny Sutton, arguing that he willfully misled the jury to convict Border Patrol Agents Ignacio Ramos and Jose Compean.

Sutton’s office did not immediately return calls from The Associated Press seeking comment Monday.

A federal jury in Texas convicted Ramos and Compean of assault, obstruction of justice and civil rights violations in the wounding of Osvaldo Aldrete Davila on the Texas border near El Paso in 2005. A federal judge sentenced Compean to 12 years in prison and Ramos to 11 years.

Appeals are pending in the 5th U.S. Circuit Court of Appeals.

“This whole case stinks to the highest parts of heaven,” said Don Swarthout, president of the Christian group. “How is it possible in America to convict two border agents for simply doing their jobs and send them to prison for 11 and 12 years? How is it possible for Johnny Sutton’s office to ruin the lives of two of our border agents based on the word of a known Mexican drug smuggler?”

The convictions caused a national firestorm among conservative lawmakers and others. Critics have repeatedly called the prosecution unjustified and the sentences extreme.

In exchange for his testimony against the agents, Aldrete was given immunity from prosecution for allegedly trying to smuggle drugs the day he was shot.

Jurors didn’t hear evidence that Aldrete allegedly smuggled marijuana into the United States several months after the shooting.

The complaint alleges Sutton’s office misled the public and jury about Aldrete’s subsequent arrest.

During his trial, Compean testified that he shot in self-defense after seeing what he believed to be a gun in Aldrete’s hand. Ramos said he fired in defense of Compean. Aldrete denied having a gun. Both agents acknowledged not reporting the incident.

    Sutton must be removed from office and executed in the middle of town square due to his treason, corruption and part in destroying America’s rule of law. He must first be ousted from the powerful office he holds and not be allowed to be employed under any circumstances any where in the U.S. I am quite sure that he would fit right in as legal counsel to any one of the barbaric drug cartels in mexico, or maybe he could take a high ranking seat as a mexican government politician.

    Yeah, sutton is scum. No question. The wrong 2 guys are in jail.

    Ramos and Campeon, railroaded by a career scum-bag and his side kick
    named Kanoff, or something like that.

    dc criminals, protecting the free flow of drugs to poison our country.

    Strange, though. I just tossed out a mail-in poll by that C.R.A.V.E. group,
    it was an opinion poll or something.
    It is never wise to give out any such info without first knowing who is asking.
    (the web is spun thicker and thicker each day, and with each layer, more sticky.)
    It struck me as odd because a while back, a telephone poll reached me (I have no idea how) but I was in a ‘mood’, so I let loose on them and told them never to call me again. If I remember right, it was this group. Hard to tell. At this stage of the game, there are lots of false front organizations springing up like mushrooms on a cattle pasture after a rain. Best not to trust any of them.
    Some may be in earnest, but I would expect that a good number are actually info- or data-mining operations, operated [even] by our own government.
    Think that they are above that?
    Strangely, and about in the same time frame, I got a call from an organization loosely related to Newt Gangrene (or whatever his name is)
    Same deal. I was in a mood, and so I kind of melted the phone in giving my opinions to the poor woman on the other end and had to spend the rest of the day scraping plastic from the floor.
    Shouldnt talk to unsolicited callers either.

    but I figger,

    I dont believe that the 1st amendment was written for symbolic purposes or with figurative intent.

    Will this freak get away with his crimes? Will Boosh grant him some sort of immunity before he leaves office? He is a stooge for the Drug Cartels and recieves high praise from the Boosh Administration. This IS the Twilight Zone!
